1.1 These Terms govern the short-term recreational accommodation agreement entered into between the Provider and the person identified as the person making the booking (the “Guest”).
1.2 The accommodation is provided only for the agreed period and does not create a residential tenancy or any right of permanent residence.
1.3 The separate House Manual and Accommodation Rules form a binding part of the booking if the Guest accepted them separately before completing the order.
2Booking and conclusion of the agreement
2.1 Before submitting the order, the Guest receives information about the dates, number of persons, total price, mandatory charges, payment method and cancellation conditions. The Guest may correct the entered information before submission.
2.2 The agreement is concluded when the booking confirmation is delivered to the Guest, unless the booking process expressly specifies another time. The Guest must be at least 18 years old and is responsible for the accuracy of the booking information.
2.3 The Guest also acts on behalf of the persons included in the booking and shall ensure that they comply with the stay rules accepted when making the booking.
3Price and payment terms
3.1 The total price and its due date are stated in the booking summary. The price includes only the items expressly listed in that summary.
3.2 Services or consumption charged separately shall be paid according to the price list communicated before use and, where measurable, according to documented consumption.
3.3 If a refundable security deposit is agreed, its amount, due date and method of refund must be stated in the booking. The deposit is not a flat-rate penalty and does not exclude a claim for proven damage exceeding its amount.
4Cancellation by the Guest
| Time the cancellation is received | Refund of amounts paid |
|---|---|
| By 4:00 p.m. on the date 30 calendar days before arrival, or earlier | 100% of all amounts paid for the booking will be refunded |
| After this time | No part of the amount paid will be refunded – refund 0% |
| No-show without prior cancellation | No part of the amount paid will be refunded – refund 0% |
4.1 Any amount refundable to the Guest under the table above will be returned by the Provider using the same payment method by which it was received, no later than 14 days after receipt of the cancellation.
4.2 A later arrival, earlier departure or failure to use part of the stay for reasons attributable to the Guest does not create a right to a refund for the unused part.
5Change or cancellation by the Provider
5.1 If the Provider cannot provide the stay due to an accident, safety risk, action by a public authority or another serious circumstance, the Provider shall offer the Guest a reasonable alternative date or refund the price of the services not provided without undue delay.
5.2 The Provider may cancel the booking if the price is not paid by the stated deadline or if materially false information has been provided. During the stay, the Provider may terminate the accommodation in the event of a serious or repeated breach of the accepted Accommodation Rules. This is without prejudice to the statutory rights of the parties.
6Right of withdrawal and complaints
6.1 For accommodation booked for a specific date or period, the statutory consumer right to withdraw within 14 days without giving a reason does not apply. Cancellation is governed by Article 4.
6.2 The Guest shall report any defect in the accommodation without undue delay, ideally immediately after discovering it, and shall allow the Provider a reasonable opportunity to remedy it. A complaint may be submitted to the Provider’s contact email address.
6.3 A consumer dispute may be resolved out of court by the Czech Trade Inspection Authority (Česká obchodní inspekce), www.coi.gov.cz and www.adr.coi.cz.
7Liability for damage
7.1 The Guest is liable for damage to the accommodation, its equipment or related property that is demonstrably caused during the stay by the Guest, persons included in the booking or visitors admitted by the Guest through a breach of a contractual or statutory duty.
7.2 The Guest shall report any damage without undue delay and provide reasonable cooperation in determining its cause and extent.
7.3 The Provider shall substantiate the basis and amount of the claim, take ordinary wear and tear, the age of the item and any increase in value resulting from the repair into account, and allow the Guest to comment on the claim. Ordinary wear and tear and faults not caused by the Guest are not considered damage caused by the Guest.
7.4 The Guest shall pay the undisputed portion of a substantiated claim within 10 days of receiving the statement of account. Any disputed portion shall be resolved by agreement or through the applicable legal procedure.
8Personal data and final provisions
8.1 Information on the processing of personal data, the camera system and online check-in is set out in the separate Privacy Policy.
8.2 Legal relations are governed by the law of the Czech Republic. The choice of law does not deprive a consumer of protection afforded by mandatory provisions.
8.3 Any individual agreement stated in the booking confirmation takes precedence over these Terms. The invalidity of any individual provision does not affect the remaining provisions.
8.4 The Guest shall receive the version effective at the time of booking in a form that allows it to be stored and reproduced.
